Scrap-Savvy Terms of Use and Copyright (Angel) Policy

Scrap-Savvy™ recognizes that individuals desire to create and sell craftwork incorporating our products, designs and images. In the interest of sharing creativity with others, we have granted permission in the form of a limited use license for Scrap-Savvy™ designs, images and other products sold by Scrap-Savvy™ that are protected under U.S. and/or international copyright laws (hereinafter referred to collectively as the “copyrighted material”) for the purpose of creating craftworks for sale in limited quantities and in a limited local geographical location. (This policy does not grant permission to reproduce the copyrighted materials in electronic form for redistribution.)

The rights granted by Scrap-Savvy ™ hereunder provide consideration for the terms and conditions set forth herein. As such, any individual using the copyrighted material pursuant to this license hereby expressly agrees to the terms and conditions set forth herein.

1. All Scrap-Savvy™ products that incorporate or utilize copyrighted material in electronic form (ie. Scrap-Savvy™ image CD’s, Downloadable Designs, Classes and Tutorials) are copyrighted by Scrap-Savvy ™ and are protected under United States and international copyright laws, which means that they cannot be copied without the written permission of Scrap-Savvy ™ including but not exclusive to, any images originating with Scrap-Savvy™ and any instructions and tutorials originating with Scrap-Savvy™. Modified files of Scrap-Savvy™ copyrighted materials may not be copied or sold in electronic format. Files are considered modified if you change the size; add and/or remove cutting lines, dashed lines, drawing and/or printed lines; and/or change the shape and/or position of any lines including the outline. Modification of our files is not limited by this statement.

2. The individual may sell or distribute personal craftwork at local community fundraisers, seasonal

boutiques or bazaars, or other temporary craft events. Personal craftwork incorporating Scrap-Savvy™ copyrighted material may be sold at a fixed retail location by a third party such as a store or mall kiosk, left in a store on consignment, or sold to other parties for subsequent resale, or sold via Internet stores (excluding eBay) provided the terms of this policy are adhered to.

3. Personal craftwork incorporating Scrap-Savvy ™ copyrighted material may be sold at fixed retail locations, by a third party such as a store or mall kiosk, left in a store on consignment, sold to other parties for subsequent resale, sold via Internet stores (excluding eBay), local community fundraisers, seasonal boutiques or bazaars, or other temporary craft events provided the terms of this policy are adhered to.

4. The use of the copyrighted material to be sold in individual retail stores (brick and mortar or internet stores) is permitted to promote sales of Scrap-Savvy s™ products and produce class kits and shall be limited to the production limits set forth herein.

5. The use of the copyrighted material to be sold on a regional or national level or for any mass

production requires a written licensing agreement with Scrap-Savvy ™. (The definition of mass produced is more than 100 copies reproduced within a thirty day period of any one design or more than 300 copies per year of any one design.) The copyrighted material is designed to work with Scrap-Savvy ™ personal and Pro cutting systems and may not be mass produced by other manufacturing means.

6. Quantities for sale of personal craftwork shall be limited by the production limits set forth herein.

7. Wherever possible, each item using or incorporating Scrap-Savvy ™ copyrighted material must be marked with “Includes Copyrighted Material of Scrap-Savvy™” in a reasonable size and location that gives reasonable notice.

8. The limited license granted herein is not a license of the Scrap-Savvy ™ name or any trademarks, trade names, trade dress or logos of Scrap-Savvy ™ and cannot be used without the express written permission of Scrap-Savvy ™. In addition, the Scrap-Savvy ™ name or any trademarks, trade names, trade dress or logos of Scrap-Savvy ™ may not be used in a manner that states, infers, or implies an affiliation with Scrap-Savvy ™.

9. You may not use Scrap-Savvy ™ copyrighted material for the purpose of creating logos, trademarks, trade names, or trade dress. (e.g., company trademarks, product trademarks, product packaging, etc.).

10. Scrap-Savvy ™ expressly reserves all moral rights in any copyrighted material.

11. Scrap-Savvy ™ reserves the right, without limitation, to terminate the limited license granted hereunder for any reason whatsoever for any individual(s). In the event that Scrap-Savvy ™ elects to terminate this license for any individual, Scrap-Savvy ™ shall notify such individual in writing of such termination. Upon notice such individual shall immediately terminate the copying, sale and/or distribution of any of Scrap-Savvy ™ copyrighted material or products or things that incorporate any of Scrap-Savvy ™ copyrighted material.

12. Persons creating personal craftwork items for sale are responsible for complying with any state and local business and tax regulations or any other laws or regulations governing the sale of goods.

13. Persons subject to this license assume all liability for suitability of their work and for any CLAIM OR cause of action arising as a result of the sale, offer for sale and/or distribution of their work and agree to indemnify and hold harmless Scrap-Savvy ™ and its artists from disputes arising from the sale, offering for sale and/or distribution of their work.

14. Scrap-Savvy™ is a Washington company. The laws of the State of Washington govern this license. The state and federal courts of Washington will have exclusive jurisdiction over any proceeding arising from this policy. Any person that operates under this limited license expressly agrees to be subject to personal jurisdiction in the courts of the State of Washington. Any failure by Scrap-Savvy ™ to enforce any of its rights will not constitute a waiver of such rights.

Any misuse or misappropriation by unauthorized persons is prohibited and will violate civil and criminal law. Shipping:

Q: What are your shipping costs?
A: You can view an estimate of shipping costs by viewing your cart. However, final shipping costs will be displayed on the Invoice you see before confirming your order. In some cases, including International orders, product descriptions may have additional shipping details/charges.  No shipping is charged for classes or downloads. On occassion we offer free shipping on larger orders such as cutters. If Free shipping offered it is only available to US Addresses, and some exclusions may apply. Please read the Insurance policy listed below.

Q: What are the shipping times?
A:We appreciate your business and will work hard to process your order quickly. Most orders process within 1-3 business days, except where posted in the items description. All Shipping times begins after the order is processed. Some items are drop shipped directly from the vendor adn their shipping times are out of our control.

Insurance Policy:
Shipping insurance is extra at your option. Reimbursement for damages must be filed with the shipper. If you do not pay for insurance, you assume responsibility for the risk of damage. Your order is carefully processed to ensure proper delivery of your order. We package your parcel to withstand normal circumstances in shipping. We cannot be held liable for problems encountered with parcels once they are entered into the mailing system. We cannot be held responsible for parcels damaged by being mishandled, lost, stolen, or left out in the weather by the shipper. However, we can adjust your order to include insurance if you so choose.  If you choose not to include insurance, your order will be shipped with a tracking. If the shipper indicates the item was delivered and you claim otherwise, it is between you and the shipper for any claims, we will assist with all paperwork within reason.

Payment Methods:
If you are interested in purchasing anything on this site, you may do so by adding the item to your shopping cart. We accept PayPal Payments or a credit card option for Mastercard, Visa, Discover, or American Express for all orders, you do not have to have a PayPal account to use your credit card via PayPal if you so choose. Subscription order must be paid with our credit card option we do not accept any form of paypal for subscriptions.

Tracking:
Q: How can I view the status of my order?
A: Go to the Customer Service, Account Information page. This page lists all your orders. Click the date of the order whose status you wish to view.

When available tracking information is provided via a thrid party email confirmation notice to the email address you provide. Please watch your email for tracking notification. In some cases these emails will go to your junk mail folder...please keep an eye out for it. We are working to offer updates available through this web site. Please see your "My Account" for any updates available.

Backorders:
Occasionally things go on back order without prior knowledge for various reasons and may take extra time to ship. Generally, we do not hold orders for delayed items we apologize if our shipping items separately inconveniences you in anyway. Please check the item`s description carefully for any known delays.  Unfortuantley, due to the hi-functionality of our web site you will be charged at the time of check out. We can not select what is charged and what is not.  Again please recognize that occassionally things go on back order without prior knowledge and may take an extra time to ship. We do our best to ship products immediately when available, however do to the nature of this business it is important to know that in many cases we work with different vendors and are at their mercy. In rare cases, some orders may drop ship from other warehouses and their shipping times and tracking confirmations are out of our control. Again, please see item description for any known delays.

Cancellations/Returns:
Due to the abuse of our generous past policies and the nature of our business and types of products we offer in our business (technology, software, downloads, classes etc), effective immediately, Scrap-Savvy has implemented a strict "all sales are final" policy. We request that you make your selection wisely as we do not accept returns/exchanges or cancellations regardless of the circumstances on Technology based products.

Some vendors have a warrenty on their products for replacement only.  In these cases we may ask that you work directly with the vendor at their request. 

In rare cases Scrap-Savvy may grant a store credit. This policy covers un-opened, un-used merchandise and excludes: Software, CDs, SD cards, design book, downloads or other copyright materials are not refundable. Please make your selection wisely.

All store credit returns, exchanges and cancellations will have to go through an approval process and in many case you will be asked to work with the vendor as an additional party bases on said vendor's policies (please see the FAQ section for each vendor). In the rare event that we do approve a store credit, there is a $35 minimum cancellation/return fee for cancelled or returned orders, including preorders due to the high cost of administrative functions.  All returns/exchanges must be approved in advance. After approval, the merchanise can be shipped back to Scrap-Savvy un-opened and un-used for a store credit less all applicable shipping charges and an additional 15% restocking fee on total purchase value with $35 minimum. This is to cover admistrative costs threfore will not be credited, not even on cancelled Preorders or layaways. 

Preorder cancellations regardless of expected ship date must be paid in full or a $50 non refundable deposit must be made.  All cancellation fees still apply.

In cases where a vendor authorizes a Refunds for used merchandise it will only be apporved in the rare case where the customer has worked towards a solution with the vendor and all parties are in contact Scrap-Savvy, discussing problems and working towards solutions. Scrap-Savvy AND the applicable vendor's refund policies apply including all applicable shipping charges and restocking fees. All return shipping is the buyer's responsibility. 
If approved refunds are usually processed within 5-10 business days of receiving the qualifing merchandise back in stock with all materials including packing materials and in proper working condition.

Software, CDs, SD cards, design book, downloads or other copyright materials are not refundable. Please make your selection wisely.

Suggestions before purchasing: Please check your hardware configurations and the spec sheets on the cutters before you order. We are not responsible if your hardware is not compatible, needs to be reconfigured or if the computing environment does not meet the needs of the cutter.

Xyron/Wishblade has a fourteen day return policy that starts the day of shipment. We will assist you on a Wishblade return if needed, however their policy clearly states that you can work with them directly.

Cricut : In the event that you need a replacementor repair for Cricut machines please follow these instructions for resolution. Call Cricut Service at 877-727-4288. Select option 3, and then select option 5. You will reach some very nice people in Warranty and Repair. Provo Craft will handle returns, repairs and replacements for the Cricuts. You can also visit www.cricut.com for email support.

Once again, all return shipping is the buyer's responsibility.


Security Key (aka Dongle) Policy for WinPCSign Scrapbooking:

 If the Security Key is determined to be defective within the first 30 days of purchase: It will be replace.  Computer compatibility issues are not covered under this replacement policy. Time must be allowed for trouble shooting to determine the cause of problems.  Computer compatibility issues are not covered under this replacement policy.  If the security key is defective, it should be returned to your retailer for testing. Following testing, defective security keys will be replaced. No refunds will be issued.  We will cover the cost of flashing a new dongle and reship to you. There may be up to a two week turn around time.

If the security key fails or breaks within 90 days of purchase, and returns it at their expense, then TSP will provide a replacement for $50. Beyond 90 days from the date of purchase up to one year from the date of purchase, a malfunctioning security device will be replaced with the charge of $75.00

All warranties are for replacement dongles only and expire after 1 year.  This warranty does not cover misplaced, lost or stolen security keys. Customers are responsible for the care and protection of their security keys. If out of warranty, customers will be required to repurchase the software in order to get a replacement.

It is the responsibility of the customer to purchase shipping insurance to cover loss or damage of merchandise. TSP will not be liable for shipping loss or damage if the customer has not purchased insurance coverage.

Privacy Policy:
Contact information including email address, telephone number, address, etc. which is provided by the user is used for the purpose of completing your order and our own promotional newsletters and offering you support via own oun private support groups. This includes information pertaining to gift recipients. Financial information including credit card numbers, expiration dates, billing address is used solely to bill the customer for their order. We do not sell your information.

We reserve the right to refuse service to anyone.
